Application for Activity Licence for Providers of Media Services


You need to apply for activity licence in case You would like to offer such services as:

  • Radio service, which uses radio frequency that is part of Estonian radio frequency plan
  • Free access television service
  • Conditional access television service
  • Satellite television service
  • Temporary television or radio service (up to 1 month)

The activity licence is issued for a certain period and is not prolonged. If you would like to offer the service after the period for which the licence was issued, You need to apply for activity licence again.

 

Legal Basis


Offering of media services is regulated by:

You need to apply for activity licence to offer radio or television service. You do not need an activity licence to offer on-demand audiovisual media service as stated in Media Services Act § 4 (1) p. 2. On-demand audiovisual media service provider has a notification obligation and he/she has to submit a notification of economic activity.

Requirements for the Applicant


While applying for the activity licence You have to keep in mind below requirements:

  • You are the person that Media Services Act applies to
  • By submitted data in the application You have to show Your sustainability of fulfilling law requirements. In case You are applying for the activity licence for providing radio service or free access television service, the application must be submitted in conformity with § 39 of Media Services Act. Business plan and plan of investments being part of an application have to prove Your sustainability of fulfilling law and licence competition requirements.
  • Application for the activity licence for providing radio service or free access television service can only be submitted during the time of announced competition. In case of radio service You also have to submit an application for a frequency licence.
  • The licence for providing radio service or free access television service is issued to the applicant who appeared to be the best-bidder in the selection procedure.
 

Transfrontier Activity


A television programme that has an active licence of any European Union Member State or a country that has joined the European Convention on Transfrontier Television does not need a licence to be issued in Estonia.

Reception and retransmition of a television programme from another state is not restricted unless in the cases provided for in § 51 of Media Services Act.

There are basic principles coming from Audiovisual Media Services Directive that are valid in all European Union Member States and EEA (European Economic Area) Member States, but every state can provide more strict or detailed rules. Thus can the regulation vary in different states.

 

Filling and Submitting the Application


Application (DOCX) for licence to provide conditional access television service, satellite television service or temporary television or radio service has to be submitted to Technical Regulatory Authority.

Below documents should be added to the application:

  • Business plan and plan of investments
  • In case an applicant is a legal person: a document certifying the legal powers of the representative of  the applicant unless the authority arises from the law or the Articles of Association of the legal person
  • the annual report for the year preceding the submission of the application if the applicant is a legal person that is not obliged to submit the annual report to the Business Register

Application for the activity licence for providing radio service or free access television service can only be submitted during the time of announced competition.

PS! A state fee shall be paid before submitting the application.

  • through the Register of Economic Activities. You can log in using Your Estonian ID card, mobile-ID or internet banking.
 

State Fee


Before submitting the application a state fee shall be paid to the Ministry of Finance (Rahandusministeerium):

When making the payment please mark the number of reference 2900080050 and explanation „riigilõiv meediateenuse loaga seotud toimingu eest“.

State fee amounts:

  • For review of the application for activity licence for providing free access television service or radio service – 640 euros.
  • For review of the application for activity licence for providing conditional access television service – 510 euros.
  • For review of the application for activity licence for providing temporary television or radio service – 75 euros.
  • For review of the application for activity licence for providing satellite television service – 960 euros.

Proceeding the Application

 

Submitted application is being proceeded as follows:

  • The decision on the issue of or refusal to issue the activity licence for the provision of conditional access television service and temporary activity licence or on the refusal to review the application shall be made by the Director General of the Technical Regulatory Authority within one month as of the receipt of the application
  • The Director General of the Technical Regulatory Authority shall make the decision on the issue of or refusal to issue the activity licence for the provision of free access television and radio service or on the refusal to review the application within three months as of the final date for submission of the applications for an activity licence
  • The decision on the issue of or refusal to issue the activity licence for the provision of satellite television service, or on the refusal to review the application shall be made by the Director General of the Technical Regulatory Authority within six months as of the receipt of the application

The applicant is being informed of the decision or refusal via e-mail.

An entry is being made to reflect the licence in the Register of Economic Activities.

If the data in the application is not sufficient, the applicant is contacted via e-mail and given a deadline to eliminate deficiencies.

Licence is valid during the time marked on the decree.

Maximum time of licence duration:

  • Providing free access television service – 10 years
  • Providing conditional access television service or radio service – 5 years
  • Providing satellite television service – 5 years
  • Providing temporary television or radio service – 1 month (in order to reflect any particular event)

On-demand Audiovisual Media Service Provider Submitting a Notice of Economic Activities


If You wish to act as an on-demand audiovisual media service (on-demand AVMS) provider, You should submit a notice of economic activities to the Register of Economic Activities.

On-demand audiovisual media service is provided for the viewing of programmes at the moment chosen by the user at his or her individual choice and request on the basis of a catalogue of programme.

On-demand AVMS features are:

  • Audiovisuality, which means, that media service is audiovisual, includes moving pictures and could be with or without sound
  • Directed to public, which means that service is communicated to the important part of the audience and service might have a clear impact on the audience
  • Service has informative, entertaining and/or educative content
  • Service has economic character, being one of the forms of economic activities and competing with television services
  • Service in TV-like
  • Service provider has editorial responsibility which means control over the selection, content and structure of a programme catalogue

On-demand AVMS do not include services, which partly offer audiovisual content which is merely incidental and does not constitute its principal purpose and those activities are mostly non-economic and do not compete with television services. For example, on-demand AVMS do not include webpages, where audiovisual content act as an addition to the main content of the webpage and do not form a subservice of a webpage, where videos are offered in a separate catalogue.

To offer on-demand AVMS You do not need to apply for a licence. On-demand audiovisual media service provider has a notification obligation.

Requirements


On-demand AVMS provider has to keep in mind below requirements:

  • You are the person that Media Services Act applies to
  • The service offered has main features stated in the Media Services Act
  • The services is in accordance with Media Services Act´s general requirements to the audiovisual media services and requirements to the on-demand AVMS.

Transfrontier Activity


To receive or retransmit an on-demand AVMS that has an active licence or registration or that is acting according to the law of any European Union Member State does not need a licence to be issued or a registration in Estonia, nor does service provider need to submit a notice of economic activity.

Reception and retransmition of an on-demand AVMS from another state is not restricted unless in the cases provided for in § 52 of Media Services Act.

There are basic principles coming from Audiovisual Media Services Directive that are valid in all European Union Member States, but every state can provide more strict or detailed rules. Thus can the regulation vary in different states.

Filling and Submitting the Notice of Economic Activity


A notice of economic activities contains the following general information:

  • in the case of an undertaking which is a legal person the name and registry code, in the absence thereof the relevant identification code of the country of its seat (the numerical or letter combination equal to the registration number), in the case of a sole proprietor the name and registry code, in the absence thereof the personal identification code or date of birth and the name and number of the identity document
  • contact details (telephone number, e-mail address and postal address) of the undertaking
  • in the case of an undertaking of another Contracting State or a third country, the address of its seat if it differs from the postal address
  • the name of the area of activity pursuant to law and the name and code in accordance with the classification established on the basis of subsection 4 (6) of the Commercial Code
  • the date of commencement of economic activities in the relevant area of activity if it differs from the date of submission of the notice of economic activities
  • the date of termination of economic activities if the economic activities are planned for a specified term
  • the name and contact details (telephone number and e-mail) of the person signing the notice, in the case of a legal person also the basis for representation (member of the management board or authorisation)

The following data has to be added to the general information:

  • webpage address of a service provider
  • name and type of the on-demand audiovisual media service and the specification of the service
  • forms and coverage areas of the accessibility of the service
  • name and contact information of the responsible editor of the programme catalogue
  • reference to the Technical Regulatory Authority as to the state supervisory authority

Ways to Submit Your Notice of Economic Activities:

Enter the Register of Economic Activities through the Estonian state portal (You can log in using Your Estonian ID card, mobile-ID or internet banking). In this case You do not have to pay state fee.

At the request of the undertaking a notice of economic activities might be entered to the Register of Economic Activities by a notary

State Fee


Submitting a notice of economic activities via Estonian state portal is free of state fee.

Submitting a notice using any other way a state fee of 10 euros has to be paid to the account of the Ministry of Finance (Rahandusministeerium):

When making the payment please mark the number of reference 2900080050 and explanation „majandustegevusteate esitamise toimingud“.

Proceeding the submitted notice


If the data provided to the registrar is insufficient, You will be informed promtly via e-mail and asked to submit the missing data.

Notice submitted to the Register of Economic Activities electronically is visible in the Register at once. The registrar enters submitted data to the Register during next working day at the latest.

The notice is valid termless.
